I found your account most interesting. The issue of parental responsibility is a burning one here in Australia too. Although I have no legal background, I would think the failure of the parents to secure the weapon might be a determining factor in this case.

Thanks for your review. Yes, the failure to secure the handgun was certainly a major factor in reaching their decision. I believe that now this case has been run against the parents, there will be more, provided the circumstances are appropriate for the charges to be laid.
Take care and have a wonderful day.

Unbelievable! I've actually heard about this change in legislation. I find it absolutely outrageous that the parents should have been convicted of manslaughter. Before long, will they be looking to indict the grandparents for their part as well? Parents beware indeed! Well done for bringing further attention to this case and the fact that it will influence other jurisdictions. Debbie

Thanks for the review. Yes, this is a decision that will change the prosecution in shooting or violence issues involving children whose parents can be shown to have adopted a rather "lax" attitude to their children's issues prior to the acts of violence.
It needs debate and I predict will become politically charged across the United States.
Anyway, I will keep an interest in the sentencing of both Jennifer and James Crumbley and the general feedback from commentators.
    Enjoy your day.
    Cheers

Excellent, and I agree with every word! I lived not far from the Sandy Hook school shootings when in Connecticut, wand I'm convinced the mom could've exercised more control over her son. My daughter has some problems, but I taught her from infancy to respect The Lorde and others, and 32 years later, she still does!

Thanks Jim for the review. Yes, I found the Crumbley case very interesting and not before time. The sentence will also be interesting as to what future cases may bring as a sentence. The jury, as members of the community spoke loud and clear in this one. Parents pick up your game.
    Take care.

I think this is what the law should do all the time, that will soon have parents sitting up and taking notice. Here, in the UK, they won't even name the 'child' who has murdered someone. I say, if they are old enough to kill, they are old enough to have their name splattered all over the newpapers. Childred know what is right and wrong, they definitely know it's wrong to kill!! I do hope England take note of this and follow the US's example. Something must be done to stop all this! Well done, Barry, this was a really interesting read. :) Sandra xx

    Sandra,
Thanks for taking time to review my comments. Yes, Australia is very much the same as the UK. For many, many years there has been talk of making parents more responsible for the action of their children. This decision, whilst being one made in the United States will give more fuel to those who advocate more responsibility being placed on parents. Let's see how it goes.
In the meantime, have a great day.
    Regards

This is totally crazy Barry and this would never happen in the United Kingdom or Australia as it is not lawful to prosecute people who have not committed a crime and we cannot be held responsible for deeds of others. A poignant post Barry, love Dolly x x x x

    Dolly,
Thanks for the review. My commentary has produced arguments from both sides of the camp so to speak. The debate on this case will gather momentum around the world. Let us just see how it all pans out.
Take care and have a wonderful day.

I remember this case, Barry. I agree with the verdicts that were the results of the trials. This is a good example to illustrate one of my beliefs. I think a couple should have to pass some sort of exam before they are allowed to have children. There are far too many parents that do not have a clue how to raise children.

Thanks, Paul for your review of my commentary. Your idea is certainly not original, but it is a popular one. If only it could be done. This decision may just spark some action that will have parents facing more legal responsibility for the actions of their children. Let's see what happens.
Take care and have a great day.

Sobering. My husband is a gun enthusiast and has a large collection. He has a secure gun safe and is responsible. He taught our grand daughter if she ever sees a gun she should run tell an adult. Set her up with a fake lighter shaped like a gun in a bathroom drawer. She came running...."Grandpa, Grandpa, I found a gun!!"
Thanks for writing that. Esther

Ha Ha I like the bit about your grand daughter and the fake lighter. Thanks for the review. Yes it is sobering and I think this is just the beginning of more parents being called to account. Of course the circumstances of each case will have differences.
Take care and have a wonderful day.

I respect your legal experience in Australia, and this is interesting, but this seems way off for how things actually work in America (and different states). With respect this case will not change anything here. Since this happened there have been dozens upon dozens of children murdering and attempting to murder others here, some with mental health issues. 12 and 7 seven year old brothers in Texas last week attempted to murder (stabbed) a 60 year old woman. No charges for the mother, who knew her 12yr son had mental health issues. No one is even trying to go after the mother. Teens in Philidelphia shot up two city buses. No look at the parents whatsoever.

Notes:

became the first persons in the United States to face a manslaughter charge over a school shooting by their child.

-This isn't entirely accurate. They weren't charged over a school shooting by their child. He could have shot up a grocery store or did a person on the street and the charges would've been the same. They were charged because they knowingly purchased a gun for minor with known mental health issues, then taught him how to use it.

The implications of such convictions will be wide ranging in the United States and also other countries that base their laws on the old English system of law and procedure. Australia is one, as are all Commonwealth countries.

-This is wild conjecture, given sates have differing laws. And America is not a Commonwealth country.

Clearly, to ignore calls of help from children as to their mental health at any particular time, and they then perpetrate an act of violence upon others, could well lead to a charge of involuntary manslaughter. A conviction is likely to lead to some period of imprisonment and a resultant disruption to the caring of other children.

- This is highly unlikely, and likely not legal. You are making great leaps, without any support.

Thanks so much for your review and your comments. It is important that people express their opinions because this decision needs discussion. The starting point prosecuting parents in the "shooting" cases has arrived. There had not been any prosecution until now. On 9th April the sentences will be handed down and the dye will be set for a lot more prosecutors to take similar steps to the one taken by the prosecutors in this case. Investigators will, in many cases, concentrate on the part parents may have played in their child causing violence to others.
I am confident the result in this case will result in much, much discussion across the United States and countries with similar legal systems.
I could go on but perhaps that is for another day.
    Thanks again.

I hope you are right, Benny, but the political and social landscape of America is more complex than you know or may be willing to admit. Let's just say, because of "who" commits the most shootings in America, going after the parents (usually parent) will not happen. It would be political suicide. This was not the case in the above story. There the prosecutor was safe to go after those parents. It's sad but an unmistakable truth in our country. And few if any, have the guts to tackle that elephant.

    Have a good one.

You are correct I am not familiar with the social landscape of America. Pity that many times the important things are not discussed properly. Happens over here to.

I very much agree with the premise of your story here. I think parents today are allowing their young people to get away with a lot of things and they claim they're just too busy to be looking after them. Part of that problem stems from the fact that both parents are having to work outside the home and there's a lot of pressure on them when they get home Someway somehow we need to figure that out. Thanks for your review. Yes, you are correct. We do need to figure it out. How much does the law need to step in?When should they step in?The prosecutors in this matter have made a stand. The jury thought they were correct. There is a long way to go in this debate.
Thanks again and have a wonderful day.
